This time, Ludmila, we’re covering a topic we’ve touched on briefly in the past but never explored in detail—the court system in Ras al-Khaimah (RAK). While we’ve discussed the courts in Dubai and Abu Dhabi at length, RAK offers a unique perspective.

For anyone unfamiliar, Ras al-Khaimah is one of the smaller emirates, just north of Dubai. Despite its size, it’s bustling with activity. It’s home to RAK Economic Zone, which provides economic activity licenses and connects investors to international markets. The emirate also hosts major industries like RAK Ceramics and Gulf Pharmaceutical Industries.

In addition, RAK is a growing tourism destination, known for its beautiful beaches and serene environment. With all this economic and social activity, I imagine there’s also a thriving legal system to support it, correct?

Indeed. RAK is a vibrant emirate that might not receive the same global attention as Dubai or Abu Dhabi, but it holds its own as a hub for tourism, business, and real estate. Many UAE residents own properties in RAK, either as weekend homes or long-term investments, often managed by gated communities.

Its appeal extends beyond residents, attracting tourists and businesses. RAK’s courts are a reflection of this dynamic landscape, and their structure and processes are tailored to meet the needs of residents, businesses, and investors.

Let’s dive into the RAK court system. How does it compare to Dubai or Abu Dhabi?

Unlike Dubai and Abu Dhabi, which have independent court systems, Ras al-Khaimah has had its own judicial system from the outset. This means that its courts are not part of the UAE federal court system, which governs most other emirates.

RAK’s courts include three levels: the Court of First Instance, the Court of Appeal, and the Court of Cassation. The Court of Cassation serves as RAK’s Supreme Court, and its decisions cannot be appealed to federal courts.

In recent years, RAK has made significant advancements in its judicial processes, aligning with broader UAE efforts to modernize the legal system.

What are some of the recent developments in the RAK court system?

RAK has introduced several new courts to streamline its judicial process and enhance accessibility. These include:

  1. The One-Day Court
    Established in 2017, this court was initially limited to civil and commercial claims up to AED 20,000. In 2019, its jurisdiction expanded to cases up to AED 500,000. The goal is to resolve disputes within one day, leveraging electronic processes for efficiency.
  2. The One-Session Court
    Similar to the One-Day Court but even more condensed, it handles simplified cases. The judge issues a judgment in a single hearing, making it a quicker option for certain disputes.
  3. The Small Claims Court
    Created in 2019, this court focuses on civil and commercial claims of up to AED 5,000. Judgments are final and enforceable within 30 days, offering a swift resolution for minor disputes.

It seems like these courts aim to make justice more accessible. How do these changes benefit residents and businesses?

Absolutely. These courts reduce the time and costs associated with litigation, making it easier for residents and businesses to resolve disputes. The publication of court judgments on the RAK court website also promotes transparency and serves as a resource for understanding legal precedents.

RAK’s approach is forward-thinking, encouraging timely dispute resolution while fostering confidence among investors and residents alike.
